Short Term Rental Rules in Evergreen, Colorado
Evergreen is unincorporated, so Jefferson County makes the rules, and the county changed them completely on 16 December 2025. Before that date there was no short term rental licence here at all. Section 46 is eight months old, which means almost everything written about running an Airbnb in Evergreen describes a county that no longer exists. What a house here actually earns.
We are not publishing a nightly rate for Evergreen. Our own property there is off the calendar for renovations, the licensing regime is eight months old, and quoting Florida numbers for a Colorado mountain market would be worse than saying nothing. What we can tell you is what the rules allow, which in this county is the part that decides whether a purchase makes sense at all.
What the licensing actually takes in Evergreen.
Most pages about this are vague because whoever wrote them has never filed one. We have a property in Evergreen that is off the calendar at the moment, so this is read straight off the regulation and the application forms rather than off a live renewal tracker.
- You may hold one investment short term rental in the whole county
- This is the rule that decides whether a plan is possible. An owner may have an ownership interest in a short term rental at no more than one property that is not their primary residence, at any time, across the whole of unincorporated Jefferson County. Not one per area. One.
- One licence per property, and one party at a time
- Only one short term rental licence is issued for a property at any time, and a licensed rental may not be let to more than one party under separate contracts at once. If you were thinking of letting a main house and a lower unit to two different groups on the same weekend, the county does not license that.
- A cap on how many licences exist at all
- Up to one percent of the dwelling units within a Fire Protection District may be short term rentals, and applications are reviewed first come, first served. A district already at its cap means no new licence at any price, which makes the queue itself part of the decision. Your property also has to be inside a Fire Protection District to qualify in the first place.
- Seven hundred and fifty feet from the next one
- An investment property cannot be within 750 feet of another property holding a permitted short term rental. That is measured at the initial application and not at renewal, so a neighbour licensing after you does not unseat you. Properties that already held a valid permit on 16 December 2025 keep an exemption from this, but only for as long as they renew before their existing approval expires. Let one lapse and you come back in as new.
- Both of those disappear if you live there
- A primary residence licence, for an owner in the property at least nine months of the year, is exempt from the 750 foot separation and from the one percent district cap. It is a materially easier licence and it is worth knowing which one you are applying for before you start.
- Somebody has to be thirty minutes away
- The application must name a Local Representative who is no more than thirty minutes from the property. That is a real constraint on managing an Evergreen house from anywhere that is not the Front Range, and it is the requirement most likely to be quietly ignored until something goes wrong at midnight.
- Ten people, whatever the house
- Occupancy is two per bedroom, or whatever the septic system allows, whichever is more restrictive, and no short term rental may exceed ten occupants regardless of bedrooms or septic capacity. You also need one off-street parking space per bedroom, which in mountain terrain is not always a formality.
- Insurance with a real number on it
- Fire, hazard and liability cover of at least five hundred thousand dollars, either as separate short term rental liability cover or a homeowner's rider that specifically names short term rental use. A standard policy will not do it, and the county asks.
- Mountain conditions are written into the rules
- Bear resistant bins are required in the Mountain Areas. Outdoor fires using wood, pellets or charcoal are prohibited outright, and propane or gas fire features need a shut-off timer. Guests have to be told about any fire restrictions in force. If the property is on a septic system it needs an inspection every year.
- Your listing has to carry the licence number
- Every advertisement must clearly show the county licence number and the approved occupancy limits, and a copy of the licence and the local representative's contact details must be displayed inside the property. That is a change to the listing copy on every channel, not a document in a drawer.
- Renewal, and what happens if it goes wrong
- The licence lasts one year and the renewal is due at least thirty days before it expires. It is issued only to the owner and it is not transferable, so buying a licensed house does not buy the licence. And if a licence is revoked, both the property and the owner are ineligible for five years. That is the hardest penalty in any market we operate in.
The county sets its application and renewal fees by resolution on a separate schedule rather than in the regulation, so we are not going to quote a figure we have not verified. Ask Planning and Zoning for the current one. The costs that will not appear on that page are the insurance minimum, the annual septic inspection and having somebody within thirty minutes. Fees and dates are what we hold as current and the city does change them, so treat this as the shape of the year rather than the last word, and confirm anything you are about to pay.
The short answers.
Do I need a licence to run a short term rental in Evergreen?
Yes, since 16 December 2025. Jefferson County adopted Section 46 of its Zoning Resolution on that date and Evergreen is unincorporated, so the county regime applies. Before then there was no licence. It is unlawful to operate without one now.
Why does everything I read online say something different?
Because most of it was written before December 2025, when there was nothing to describe. Check the date on anything you read about Evergreen short term rentals, including this page. The county publishes the regulation itself and a host guide, and both are worth reading directly.
Can I own more than one short term rental here?
Not as investments. An owner may hold an interest in at most one short term rental that is not their primary residence, anywhere in unincorporated Jefferson County. A primary residence licence sits outside that, so an owner living in one property and letting it can be in a different position from an owner letting a house they do not live in.
What is the 750 foot rule?
An investment short term rental cannot be within 750 feet of another property that already holds a permitted one. It is tested when you first apply, not at renewal. Primary residence licences are exempt from it. And a property that held a valid permit on 16 December 2025 keeps an exemption, but only while it keeps renewing before expiry.
How many guests can I take?
Two per bedroom, or whatever the septic system supports, whichever is lower, and never more than ten people regardless. You also need an off-street parking space for every bedroom.
Do I need someone local?
Yes. The county requires a named Local Representative within thirty minutes of the property. It is the single hardest requirement to satisfy from out of state and the one we would want to settle before agreeing to run anything here.
What happens if I get it wrong?
The Director may revoke a licence for failure to comply, and revocation makes both the property and the owner ineligible for five years. There is also a 24 hour county complaint line, so enforcement is not theoretical.
Do you manage properties in Evergreen?
We have a property here, currently off the calendar for renovations. Whether we take on another depends on the local representative requirement more than anything else, and we would rather work that out with you honestly than promise coverage we would have to arrange afterwards.
